New Trial Proceedings

The United States Patent and Trademark Office (Office or USPTO) revised the rules of practice to implement the provisions of the Leahy- Smith America Invents Act (ββAIAββ) that create the new inter partes review proceeding, post-grant review proceeding, and transitional post-grant review proceeding for covered business method patents, to be conducted before the Patent Trial and Appeal Board (Board).
This section will be heavily tested on the exam. On the day of the exam, you will have access to a PDF file covering it since it is not yet incorporated into the MPEP. You may find a link to that PDF file above in the summary. You can expect to see 7 to 10 questions on this material on your exam.
