   Summary:

This appendix covers the 35 U.S.C. 102 Rejections, both pre-AIA and AIA versions. 35 U.S.C. 102 deals with rejections based on the prior art. There are several sections within this statute and this appendix covers them all.

This section will be heavily tested. You will likely see 10+ questions on material from this chapter and several of them will be highly complex. We have had a few clients claim they had as many as 20 questions covering 35 U.S.C. 102 with almost of them pertaining to AIA.

It's suggested that you spend time reviewing all the different sections of the statute and understand the AIA versions of 35 U.S.C. 102. Many clients report only seeing 1 to 2 questions on pre-AIA at this point. It's great if you can review both pre-AIA and AIA, but try to focus more of your time on AIA at this point.

Make sure you're familiar with all the material here and know where to find it when searching the MPEP.

This section is one of the more complex, therefore, it is important to become familiar with the details it covers and where to find specific topics within the MPEP. Please review this chapter several times along with taking the Workbook quizzes (both the fill-in-the-blank + true/false as well as the short answer quiz). Patent Bar questions on 35 U.S.C. 102 are very complex.

You will want to understand the facts or at the very least know where the material is located within the MPEP from this very important chapter. This includes taking notes and organizing them in a way that makes the most sense to you like you would expect to do when studying any other complex material.
